GAO Report (PDF)
The GAO reported not only remaining concerns about competition and capacity, but also that shippers in selected markets may be paying excessive rates that could be seen as an abuse of market power.

Selected quotes:

  • “While rates have generally decreased since 1985, other costs [such as fuel surcharges and railcar ownership] have been passed on to shippers. ... Rates do not reflect the total cost of shipping by rail.” – Page 16

  • “Our analyses suggest a reasonable possibility that shippers in selective markets may be paying excessive rates related to a lack of competition. This provides the impetus for STB—which has the statutory authority to inquire into and report on railroad practices—to analyze competitive markets in the rail industry and, where appropriate, consider the range of actions to address problems associated with the potential abuse of market power.” – Page 68
